TERMS AND CONDITIONS OF THE OEN WEBSITE AND MOBILE APPLICATION
§1. Definitions
Whenever the following phrases and terms are used in the Regulations, they shall be understood as:
- Personal data controller – an entity that, alone or jointly with others, determines the purposes and means of processing personal data.
- OEN Mobile Application – software owned and managed by OEN in the form of a mobile application called OEN, within which the User may use the Services offered by the Service Provider using the Account, available free of charge at www.oen.com in the Google Play Store and App Store for download and use.
- Price to be paid – the value expressed in monetary units that the Customer is obliged to pay to OEN for the Product and delivery costs.
- Processing Time – the time required to produce a Product or prepare it for shipment, up to 7 Business Days, unless a shorter period was declared at the time of purchase for a given Product, counted from the date of crediting the OEN bank account or settlement account and after the Order is accepted for processing.
- Dietitian – a person with appropriate qualifications and experience, conducting consultations with Users on behalf of OEN regarding the principles of supplementation, providing dietary care to Customers, consulting on the composition of Products based on other data and information provided by the Customer.
- Working day – any day from Monday to Friday, excluding public holidays referred to in the Act of 18 January 1951 on public holidays.
- FAQ (Frequently Asked Question) – a tab available at www.oen.com/faq, containing answers to the most frequently asked questions.
- Registration Form – an electronic form available on the Website and the Mobile Application, enabling the creation of an Account.
- Order Form – an electronic form available on the Website and the Mobile Application, used to place Orders by adding Products to the Cart and specifying the terms of sale, including payment options and delivery methods.
- Customer – a natural person, including a Consumer, who has full legal capacity and is over 18 years of age, who concludes an Agreement with OEN for the delivery or sale of a Product.
- Account – a feature of the OEN Website and Mobile App, identified by a unique name (ID or email address), created for the User based on their email address and security password.
- Website – the website operated by OEN, available at: www.oen.com, through which the User can obtain information, in particular about the Product, its composition and price, and place an Order.
- Seller or OEN – OEN WELLNESS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, entered into the Register of Entrepreneurs of the National Court Register, being at the same time the owner of the Website, the OEN Mobile Application, a service provider and a supplier.
§2. General provisions
The website is an ICT platform enabling the conclusion of distance contracts and the provision of services electronically. The OEN Mobile Application is software running on mobile devices, enabling the conclusion of distance contracts and the provision of services electronically. The website and the OEN Mobile Application are maintained and operated by OEN, which is their owner.
These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Website or Mobile Application. The provisions of these Terms and Conditions are not intended to exclude or limit any rights of Consumers under mandatory provisions of law, and any possible doubts shall be resolved in favor of the Consumer.

§3. Personal data
The controller of personal data processed in connection with the provision of services and the implementation of contracts described in the Regulations will be OEN.
In matters related to personal data protection, contact OEN is possible via e-mail at customercare@oen.com or via traditional mail by writing to OEN.
To assist in complying with personal data protection laws and to monitor compliance, OEN has appointed a Data Protection Officer.
§4. Rules for the provision of services by electronic means
OEN provides the following Electronic Services via the Website and Mobile Application: enabling the placement of an Order by completing the Order Form; providing the Regulations, Order Form, Website offer and Privacy Policy; maintaining the Account; Newsletter.
The provision of Electronic Services by OEN is free of charge.
§5. User Account
The User has the option to create an Account in accordance with the provisions of this paragraph. In order to register an Account, a new User completes the Registration Form by providing an e-mail address and a password.
OEN reserves the right to delete the User Account or temporarily limit the possibility of using the Website and/or the OEN Mobile Application in the event of a breach by the User of applicable law or the provisions of the Regulations.
§6. Procedure for concluding the Agreement
To place an Order, the User completes the Order Form. The Customer selects the "I declare that I have read and accept the OEN Terms and Conditions" box and clicks the "I am purchasing and paying" button. OEN immediately confirms the Order via email to the address provided during registration or when placing the Order.
§7. Payment method and deadline
OEN will inform you of the Price to be paid no later than before you place your Order. The Price to be paid, provided during Order placement, is expressed in the Customer's selected currency and is gross (includes VAT).
§8. Costs, method and date of delivery
OEN delivers the Product via a courier company to the address indicated in the Order. The processing time is up to 7 Business Days, unless a different, shorter period was declared upon purchase for a given product.
§9. Complaints procedure
OEN undertakes to provide Customers of the Website and Mobile Application with Products that are compliant with the Agreement. Notification of non-compliance of the Product with the Agreement and submission of an appropriate request may be made via e-mail to the following address: complaints@oen.com.
§10. Withdrawal from the Agreement
The right to withdraw from the Agreement without giving any reason applies only to the Customer who is a Consumer. A Consumer who has concluded a Distance Agreement via the Website or Mobile Application may withdraw from this Agreement within 14 days without giving any reason.
§11. Extrajudicial methods of dealing with complaints
In the event of a dispute between OEN and a Customer who is a Consumer, the Customer may use out-of-court complaint and redress procedures, in particular applying to the provincial inspector of the trade inspection.
§12. Opinions
OEN enables the posting and access to Opinions about Products, Services, the OEN Website and Mobile Application. Opinions are shared directly on the Website and via social media and independent services.
§13. Final provisions
Agreements concluded via the Website or Mobile Application are concluded in accordance with Polish law. OEN reserves the right to amend the Regulations for important reasons. The Regulations enter into force on 22 May 2025.
